TBI Agent David Davenport Memo
On March 9, 1992, Tennessee Bureau of Investigation Agent David Davenport wrote a lengthy memo after a conversation he said he had with Gary Wayne Sutton at the Sevier County Jail.
There are just a few problems.
- Gary refused to sign the waiver
- Jail logs show that Gary wasn't taken from his cell until 11:42 AM; he could not have been in the room at 11:40 AM when Davenport allegedly asked him to sign it.
- It was a 5 minute walk from Gary's jail cell to the interview room, according to testimony from the Sevier County Jail lieutenant. That means Gary could not have been in the room at 11:45 AM when Davenport signed the statement. His earliest arrival time would have been 11:47 AM.
- David Davenport signed Mark Turner's name as a witness.
